Shipping policy

This Canadian Shipping Policy (the “Policy”) governs the terms and conditions under which Oxide Hookah (“Oxide Hookah”, “we”, “us”, or “our”) offers shipping, delivery, and pickup services for orders placed by customers residing in Canada. This Policy forms an integral part of our Terms and Conditions of Sale and shall be read together with our Privacy Policy and any applicable provincial or federal consumer protection laws.
1. Order Acceptance and Fulfillment
1.1 Order Confirmation
Upon placement of an order through our website (the “Site”), you will receive an automated order confirmation email. This confirmation does not signify acceptance of your order, but merely confirms that we have received it.
1.2 Order Processing Timeline
Orders placed for delivery within Canada are generally processed within one (1) to two (2) business days, excluding weekends and statutory holidays. Processing times are subject to change without notice due to inventory availability, volume of orders, and operational constraints.
1.3 Right to Refuse Fulfillment
We reserve the right, at our sole discretion, to refuse or cancel any order placed for any reason, including but not limited to product availability, inaccuracies in pricing, suspected fraud, or violation of our Terms and Conditions.
2. Shipping Carriers and Service Levels
2.1 Designated Carriers
Domestic orders are shipped via third-party carriers, including but not limited to Canada Post and United Parcel Service (UPS). Oxide Hookah reserves the right to substitute carriers at its discretion, provided such substitution does not materially affect the service level paid for by the customer.
2.2 Carrier Terms and Risk of Loss
Once an order has been tendered to the carrier, the risk of loss and title for all items purchased shall pass to the customer. Oxide Hookah assumes no liability for delays, mis-deliveries, or losses caused by the carrier. Customers are encouraged to review the respective carrier’s shipping and liability policies.
2.3 Shipping Methods and Delivery Windows
Available shipping options, including standard and expedited service levels, are displayed at checkout. Estimated delivery timelines are provided by the carrier and are non-binding. Oxide Hookah does not guarantee delivery within any specific timeframe.
3. Shipping Rates and Fees
3.1 Real-Time Rate Calculation
Shipping fees are calculated at checkout in real time based on factors including, but not limited to, the package weight, dimensions, delivery location, and service level selected.
3.2 Flat-Rate Delivery (Calgary)
For orders destined within Calgary, we offer a flat-rate shipping fee, regardless of package weight or volume. This rate is subject to change without prior notice.
3.3 Taxes on Shipping Charges
All shipping and handling fees are subject to applicable Goods and Services Tax (GST) and, where applicable, Provincial Sales Tax (PST) or Harmonized Sales Tax (HST) in accordance with Canadian tax regulations.
4. Local Pickup – Calgary, AB
4.1 Eligibility and Threshold
Local pickup is available exclusively for customers located in Calgary, Alberta, and is limited to orders with a minimum merchandise subtotal of $50 CAD.
4.2 Scheduling and Appointments
All local pickups must be scheduled in advance by contacting us at 403-477-7757. Pickup appointments are subject to availability and will be confirmed upon receipt of payment and processing of the order.
4.3 Verification Requirements
Customers must present a valid government-issued photo identification and order confirmation at the time of pickup. Oxide Hookah reserves the right to refuse release of goods in the absence of proper identification.
5. Address Accuracy and Customer Responsibility
5.1 Duty to Provide Accurate Information
It is the sole responsibility of the customer to provide a complete, accurate, and deliverable shipping address at the time of order placement. This includes unit/apartment numbers, buzzer codes, postal codes, and correct spelling of names and street addresses.
5.2 Consequences of Inaccuracy
Oxide Hookah shall not be held liable for delivery failures or losses arising from errors or omissions in shipping information submitted by the customer. Orders returned due to such errors shall not be eligible for a refund of shipping charges and may be subject to an additional re-shipping fee.
6. Delivery, Delays, and Force Majeure
6.1 Non-Guaranteed Delivery Dates
All delivery dates provided are estimates only. We do not guarantee delivery by a specific date, and we shall not be held liable for delays caused by the carrier, inclement weather, labor disruptions, acts of government, or other force majeure events beyond our reasonable control.
6.2 Undeliverable Packages
If a package is returned to us as undeliverable by the carrier, we will attempt to contact the customer for resolution. Additional shipping fees may apply. If we are unable to establish contact within a reasonable time frame, the order may be deemed abandoned without refund.
7. Claims for Loss or Damage in Transit
7.1 Timeframe for Reporting
Claims for goods that are lost or damaged in transit must be submitted in writing to sales@oxidehookah.com within forty-eight (48) hours of delivery confirmation or expected delivery date.
7.2 Evidence and Documentation
The customer must provide supporting documentation, including photographic evidence of damage, a copy of the packing slip, and original packaging materials, in order to initiate a carrier claim.
7.3 Remedy
Subject to carrier approval, Oxide Hookah may, at its sole discretion, issue a replacement or credit in the amount of the damaged or lost merchandise. No claim shall be honoured where customer negligence or misuse is evident.
8. Limitation of Liability
To the maximum extent permitted by law, Oxide Hookah disclaims any and all liability for direct, indirect, incidental, punitive, or consequential damages arising from or related to shipping delays, delivery failures, or carrier misconduct. Our total liability in any circumstance shall not exceed the purchase price of the goods in question, excluding shipping and handling fees.
9. Governing Law
This Policy shall be governed by and construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.
